Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of chikindrip.com, our online ordering and account features, and other services we make available (the “Services”). By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Using our Services

You must use the Services only lawfully and provide accurate, current information. You are responsible for safeguarding your account and for activity that occurs through it. Notify us promptly if you believe your account has been accessed without authorization. We may suspend or end access where reasonably necessary to protect our guests, business, or Services, or for violations of these Terms.

Orders, prices, and availability

Product descriptions, menu items, prices, hours, and availability may change without notice. Prices, taxes, fees, and applicable delivery charges shown at checkout apply to your order. An order is an offer to purchase; we may accept, decline, limit, or cancel it where permitted by law, including for suspected fraud, incorrect pricing, unavailable items, or operational constraints. If we cancel a paid order before fulfillment, we will arrange a refund of the amount paid for the canceled item or order as appropriate.

Please review your order before submitting it. Pickup and delivery times are estimates, not guarantees. Once preparation has begun, orders generally cannot be changed or canceled. If there is an issue with an order, contact the restaurant promptly at (669) 900-3829 or info@chikindrip.com so we can review it.

Payments and third-party services

Payments and some ordering functionality are provided by Square. When you use Square-enabled checkout, you may also be subject to Square's applicable terms and privacy notices. Square processes payment information under its own policies; Chikin Drip does not store full payment-card details submitted through Square. Our Services may also link to or integrate with third parties such as delivery marketplaces and social-media platforms. Their services are governed by their own terms and privacy practices, not these Terms.

Food safety and allergens

Our food may contain or come into contact with allergens, including milk, eggs, wheat, soy, sesame, peanuts, tree nuts, fish, shellfish, and other ingredients. Ingredients, preparation methods, and suppliers may change, and we cannot guarantee that any item is allergen-free or suitable for a particular dietary need. Please tell staff about an allergy before ordering and use your own judgment about whether an item is appropriate for you.

SMS account verification

By providing your mobile number and requesting account creation or sign-in, you consent to receive a one-time transactional security code from Chikin Drip at that number. Message and data rates may apply. For questions or issues, contact info@chikindrip.com. To stop messages, reply STOP at any time; this may prevent SMS verification from working until another verification method is used. Carriers are not liable for delayed or undelivered messages. SMS verification is not a marketing program and consent is not a condition of purchasing food.

Intellectual property

The Services and their content, including our name, logos, menu content, photographs, text, design, and software, are owned by or licensed to Chikin Drip and protected by applicable law. We grant you a limited, personal, revocable, non-transferable right to use the Services for their intended purpose. You may not copy, modify, distribute, scrape, reverse engineer, or exploit the Services or content without our prior written permission.

Disclaimers and limitation of liability

To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee uninterrupted, secure, or error-free access. To the fullest extent permitted by law, Chikin Drip and its owners, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Services. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Chikin Drip and its owners, employees, and service providers from claims, damages, losses, and expenses arising from your unlawful use of the Services or violation of these Terms.

Changes, governing law, and contact

We may update these Terms by posting a revised version with a new effective date. Your continued use after the revised Terms take effect means you accept them. These Terms are governed by the laws of California, without regard to conflict-of-law rules, except where applicable law requires otherwise. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Santa Clara County, California, unless applicable law provides another forum.
